Diessel Price hike by Rs.5.00.

Our political parties reaction on this move!

Trinamool Congress is set to lead a street rally in Kolkata on Saturday demanding their rollback.

Key UPA ally DMK described the diesel price hike as 'very high' and unexpected and sought a roll back of the measure. Party chief M Karunanidhi said the hike would further affect the poor and the salaried class who are already reeling under high prices of essential commodities.
West Bengal Left Front chairman Biman Bose condemned the union government's decision to hike diesel prices, saying such "anti-people" decisions will have a "disastrous impact" on the daily life of the masses. "The common people is currently reeling under the pressure of price rise of essentials. This decision of increasing the price rise of diesel by Rs.5 will have a disastrous impact on their daily life," said Bose in a statement.
Punjab chief minister Parkash Singh Badal criticised the Centre for the "unwarranted and steep" increase in price of diesel and demanded an immediate and complete withdrawal of this hike. In a statement , Badal said the hike of Rs.5 in price of diesel was absolutely "unrealistic and arbitrary."
CPI(M) led Opposition Left Democratic Front in Kerala called for a state-wide hartal against the diesel price increase on September 15.

Samajwadi Party announced that it would hold a sit-in against the move across the state. "The move to hike diesel price is anti-people and will increase prices. Samajwadi Party opposes the move and will hold sit-in across the state to protest the hike," SP spokesman Rajendra Chaudhary said.

The NCP has demanded a rollback saying the change will further burden on the common man. "The Centre should consider rollback in diesel price and should not put a cap on subsidised LPG especially given the high price of essential goods thereby affecting the common man," NCP spokesperson Nawab Malik said.

The CPI
termed as "disastrous" the decision to hike diesel prices by Rs. five per litre and restrict supply of subsidised cooking gas to six cylinders per household in a year. "It is a disastrous decision. It will increase the cost of production. The diesel price hike by Rs. five per litre is unprecedented while the decision on limiting supply of subsidised cooking gas to six cylinders per household in a year is unacceptable. We shall oppose it tooth and nail," CPI MP Gurudas Dasgupta said.
AIADMK chief and Tamil Nadu chief minister Jayalalithaa demanded immediate rollback of Rs. five hike in diesel prices, besides the ceiling on supply of subsidised cylinders.

Pension issues in MTNL and BSNL : Lok Sabha Q&A

GOVERNMENT OF INDIA
MINISTRY OF COMMUNICATIONS AND INFORMATION TECHNOLOGY
LOK SABHA
UNSTARRED  QUESTION NO 3970
ANSWERED ON  05.09.2012

PENSION ISSUES IN MTNL AND BSNL

3970 . Shri JAYARAM PANGI
Will the Minister of COMMUNICATIONS AND INFORMATION TECHNOLOGY  be pleased to state:-
(a)  whether the issues relating to Pension to Corporatized Telecom Department namely of MTNL and BSNL remain unresolved for a long period;
(b)  if so, the details thereof and the reasons therefor; and
(c)  the action taken by the Government to resolve the pension issues along with the time frame fixed for the same?

ANSWER

THE MINISTER OF STATE IN THE MINISTRY OF COMMUNICATIONS AND INFORMATION TECHNOLOGY (SHRI MILIND DEORA)
(a) The pensionary benefits to the absorbed employees of BSNL are covered under Rule 37-A of Central Civil Services (Pension) Rules, 1972, and the same are being paid by the Government. The pensionary benefits to absorbed employees of MTNL are being paid by MTNL. MTNL employees Associations/Unions are demanding payment of pensionary benefits by the Government.

(b) & (c) The details of the action taken, with the present status are placed at Annexure-I.

Annexure-I

LOK SABHA ANNEXURE UNSTARRED QUESTION NO. 3970 DATED 05-09-2012

MTNL was established on 1.4.1986 and employees were initially transferred to MTNL on deemed deputation and absorbed in MTNL as per their options. The date of absorption for  Group C and D employees was 1.11.1998 whose  pensionary benefits are governed by DOP&PW’s Office Memorandum dated 5.7.1989, whereas the date of absorption for Group A and B employees was 1.10.2000 whose  pensionary benefits  are governed by  Rule 37-A of CCS (Pension) Rules, 1972.

Rule 37-A was notified at the time of formation of BSNL.  The pensionary benefits of Government employees who got absorption in BSNL w.e.f. 01.10.2000 are governed by Rule 37 A of CCS (Pension) Rules, 1972. As per the provisions Sub-Rule 21 of Rule 37-A,  the absorbed employees of BSNL are paid pensionary benefits by the Government.

After the notification of Rule 37-A on 30.9.2000, MTNL employees/Associations have been demanding for similar treatment regarding payment of pension/pensionary benefits as given to BSNL employees.

The matter regarding applicability of Rule 37A to MTNL was considered by Committee of Secretaries    in its meeting held on 14.12.2004 in which it was observed that the issue is well settled and should not be reviewed at this stage on the grounds that there are disparities in pay scales between MTNL and BSNL staff and in majority of the pay slabs, BSNL was given one scale below than MTNL.  Hence, the existing system of payment of pension would continue.

The MTNL Associations/employees are continuously demanding for payment of pensionary benefits to MTNL employees at par with BSNL employees. They are also not supporting for  creation of Pension Fund/Trust as required under the Rules.

The matter was again discussed in a high level meeting during 2007 and accordingly a Cabinet Note was submitted on 23.2.2009. However, due to differences of opinion among the concerned nodal Departments on the issue, it was desired that the difference of opinion may first be resolved in Committee of Secretaries before placing the issue in the Cabinet. Department of Legal Affairs has asked for fresh opinion of nodal Departments. The opinion of Department of Pension and Pensioners Welfare as well as Department of Public Enterprises have since been received. Opinion on Department of Expenditure is still awaited. Further, as per the discussions held in the Parliamentary Committee of Petitions on 11.7.2012, CMD, MTNL is also exploring the possibilities of MTNL employees’ representatives accepting the BSNL pay scales.  In parallel, the groundwork for creation of Pension Fund/Trust for payment of pension to MTNL employees as per Rules/orders has also been initiated by this Department/MTNL.  Being a matter of policy, it is not possible to fix any time-frame.  Meanwhile, the pensionary benefits to absorbed employees of MTNL are being paid by the MTNL.

BSNL losses widen to Rs 8,851 cr in FY’12 - P
TI
----------------------------------------------------
New Delhi, Sept 2:
State-run BSNL’s losses widened to about Rs 8,850.70 crore during 2011-12 mainly due to regulatory expenses and non-receipt of funds for its rural landline operations.
The company had reported a loss of Rs 6,384.26 crore in 2010-11. Total revenue declined to Rs 27,933.5 crore from Rs 29,687.62 crore. “During 2011-12, we were in a position to arrest losses. However, due to some regulatory issues there was adverse impact of around Rs 3,100 crore on our financial performance,” BSNL Chairman and Managing Director R.K. Upadhyay told PTI.

BSNL’s profits started declining continuously from Rs 10,183 crore in 2004-05 before recording a loss in 2009-10.

Outgo on salaries, spectrum procurement

During 2010-11, BSNL losses rose to Rs 6,384 crore mainly due to hefty outgo on salaries and expenses borne by the PSU for procuring 3G and BWA spectrum.
Upadhyay said the company did not receive around Rs 1,600 viability gap funding for its rural landline operations from the Government which pulled down BSNL’s income.

Licence fee, spectrum charges
There was also an additional expenditure of around Rs 1,500 crore on licence fees and spectrum charges following a Supreme Court order during 2011-12, he added. “Our income was less by about Rs 1,600 crore due to non-receipt of viability gap funding for rural landline operations. “Expenditure were more by Rs 1,500 crore due to additional licence fee and spectrum charges paid even for previous
years,” Upadhyay said.

Viability gap funding

The Telecom Commission, an inter-ministerial body, in its meeting on September 3 is expected to discuss the issue of providing viability gap funding to the company.
Though BSNL CMD did not share any projections on financial performance for the ongoing fiscal, he said that the company is making effort to utilise its assets, building network capacity for handling a large subscriber base and exploring new sources of income which will help company reduce the losses. According to the Telecom Regulatory Authority of India, the company had 69.08 per cent and 10.52 per cent market share in landlines and wireless (mobile telephony) connections as on June 30, 2012.

Base price set for auctioning spectrum will not affect BSNL: Chairman and Managing Director R K Upadhyay

The "highest authority of telecom had announced the price after a lot of deliberations and views by TRAI",BSNL Chairman and Managing Director R K Upadhyay told reporters here last night.

He said pricing would not make significant dent on BSNL. "However, it could be disadvantageous while renewal process is undertaken," he said.

A meeting of the Union Cabinet, chaired by Prime Minister Manmohan Singh, on Friday agreed to price 5 MHz of airwaves in the 1,800 Mhz band at the lower end of the Rs 14,000 crore to Rs 15,000 crore reserve price band suggested by a ministers' group.

Upadhyay said he is hopeful of releasing BSNL's financial results of 2011-12 by September, adding that auditing process is in progress.

He said the PSU telecom major is likely to at least break-even. He maintained that roughly 52-53 per cent of the total expenditure goes towards wages bill and other establishment charges.

The public sector telecom major is to tap its strong infrastructure to garner additional revenue and profits.

BSNL is appointing a consultant to advise them on monetisation of real estate holdings and other avenues with which additional revenues could be generated utilising in an optimum manner the massive infrastructure accrued in the last decades.

BSNL would also diversify its operations by establishing video conferencing centers and wi-fi spots across the country where the market potential is lucrative.

The company would also utilise the strong training centers established all over the telecom circles to impart training for the youth on skill development and other IT disciplines.

To a question on the outcome of the recently initiated upgradation of land line billing system, Upadhyay replied that it was none other than a major transformation in the telecom history of India. As much as 330 Telecom SSAs had to be integrated, networked for the billing process.

A detailed survey is deployed on the outcome of the exercise and certainly it would have benefited BSNL in terms of revenues and services uptake.

On the issue of 14.37 million lines augmentation tender, he said that purchase orders have been issued and suppliers will start supply requisite equipments from next month.

He said the exercise is likely to culminate in the next 7-8 months.

The financial implication was to the tune of Rs 3,500 crore and he was hopeful of revamping and upgrading the BSNL network across the country with special focus in rural areas.

2G spectrum: Cabinet approves Rs 14,000 crore base price for auction
Commenting on the cabinet's decision COAI said that a Rs 14,000 crore base price is too high and that with the approved price there will be no case for business.
Commenting on the cabinet's decision COAI said that a Rs 14,000 crore base price is too high and that with the approved price there will be no case for business.
NEW DELHI: The Cabinet today fixed a minimum or base price of Rs 14,000 crore for the Supreme Court mandated auction of telecom spectrum.

The Cabinet, headed by Prime Minister Manmohan Singh, decided to fix the reserve price at the lower end of the Rs 14,000 crore to Rs 15,000 crore band that was recommended by an Empowered Group of Minister (EGoM), official sources said.

The EGoM had suggested a reserve price at Rs 14,000-15,000 crore for 5 Mhz of airwaves as against around Rs 18,000 crore recommended by sectoral regulator Trai for the auction of spectrum vacated from cancellation of 122 licences by Supreme Court.

Sources said the Cabinet approved levy of annual spectrum usage charge of 3 to 8 per cent on different slabs of revenue as was recommended by the EGoM headed by P Chidambaram.

Chidambaram has been made the Finance Minister in a minor Cabinet reshuffle early this week.

The apex court had in February this year cancelled 122 licences issued by the then Telecom Minister A Raja in 2008 and asked the government to conduct fresh auctions by August 31. But this deadline may not be met and the government may approach the apex court for extension of the timeline.

The reserve price fixed would be a disappointment for the telecom industry which had been pitching for a 80 per cent cut in the reserve price suggested by TRAI which they felt would lead to up to 100 per cent hike in mobile telephone charges.

The auction is crucial for companies like Uninor andSistema Shyam Teleservices, who have time till September 7 to offer their services after which they will be forced to close down their operations in case they fail to get a licence.

BSNL: Bouncing Back?

It was a make-or-break year for BSNL but the company fared very well. On revenue terms, the company has shown a drop in revenue from `29,688 crore in FY11 to `28,447 crore in FY12 but on the PAT (profit after tax) front, the company has improved significantly by netting `8,347 crore vis-a-vis `6,384 crore in FY11.

The company has done extremely well on mobile and NLD services. On the mobile front, the company has increased its revenue by 31% to net `6,482 crore. With respect to NLD services, the company has increased its revenue by `698 crore to net `5,646 crore. On mobile services, the company is doing extremely well and 3G services are now available in 963 cities and the services is available to all its mobile customers. Presently, non-voice contributes around 13% of the overall mobile revenue and the company plans to increase it by entering into non-exclusive agreements with VAS players.

On the capex front, the company has invested `5,000 crore in FY12 for ongoing GSM, broadband, and fiber-to-the-home projects but this year the company plans to invest `9,086 crore and more focus is on mobile and broadband services. Recently, BSNL has finalized 10.15 mn GSM line order to ZTE worth `3,200 crore for northern and southern zones. The order is planned to be executed within one year for both 2G and 3G services and will involve planning, financing, engineering, supply, installation and testing, commissioning and annual maintenance of GSM lines.

On the broadband front, the company is the undisputed leader with more than 9 mn subscribers thanks to the timely availability of equipment and introduction of VAS services like games on-demand, music on-demand, education on-demand, and others.

The company has also launched BWA services in rural areas of the country for connecting rural CSCs (common service centers) and village panchayats for the government program. Presently, WiMax service is operational in 169 cities of Kerala and 50 cities of Punjab. In future, the company doesn't want to operate BWA service in all the circles but plans to be selective.

The company has been identified for NOFN project due to its reach and fiber resources. It has 700,000 km of optical fiber routes countrywide and a major part of it is the rural areas. This network largely overlaps all other blocks of the country. BSNL's fiber connectivity is already available in 6,000 panchayats out of 2.5 lakh panchayats in the country.

On the enterprise part, BSNL has transformed a lot. The company is aggressively looking at the enterprise market in a big way by imparting training to the teams, focusing on solutions, and account expansion.

The company is providing end-to-end communication solutions to government departments, PSUs, banks, airlines, and corporates in big way. Some of the projects bagged by the company include: CCTNS project, department of justice project for connecting all the courts in India, and NME-ICT project for providing internet bandwidth to colleges.

In terms of numbers, BSNL's enterprise has done well as the company has bagged orders worth `2,985 crore and plans to achieve revenues of `3,561 crore in FY13. To give a big push to the enterprise division, the company has established 9 IDCs (internet data centers) to be used for co-location, hosting, managed services and cloud services along with Sai InfoSystems and Dimension Data.

In its quest to generate additional revenue, the company has signed master service agreements with 9 operators on a pan-India basis. Till date, the company has leased out 1,526 sites and plans to lease 3,000 BTS tower sites in FY13. Apart from this the company is also looking at utilization of land and building for call centers/BPOs, utilization of telecom factory infrastructure, broadband connectivity to schools, establishing Wi-Fi network, and leasing out CDMA/EV-DO network.

It's a good beginning for the company as the Indian government has identified BSNL as one of the three players to deploy NOFN (national optical fiber network) due to its reach and fiber resources. The company is awaiting commercial clearance for doing a pilot in Arain Block of Ajmer district of Rajasthan which will cover 30 panchayats. All this holds lot of promise for BSNL in future.

BSNL's Rules for Recognition

The BSNL came into existence on 1st October 2000 but could not evolve its own Rules
for recognition of non-executive unions as yet. The unions accepted the code of Discipline
meant only for central Trade unions as the company was then not in position to frame its
rules. In course of 4th verification the Dy. Chief Labour Commissioner who attended the
meeting on behalf of CLC stated that the PSU can formulate its own rules in consultation with
the unions.

The "SR Cell" due to obvious reasons delayed and finally bulldozed the demand of majority
of unions in the name of consensus forgetting and deliberately ignoring the difference between
unanimity and consensus. This led to litigations and filing of Writ Petitions at Chennai and
Ernakulam High Courts by NFTE BSNL and NU BSNL workers (FNTO) respectively. The
Hon'ble High Court at Ernakulum has now issued the following directions to CLC and the
management for change in rule.

1) The third respondent is directed to convene a meeting of the Trade unions of the
employees as well as the management of the second respondent and to ascertain whether
there is a consensus among the unions for effecting changes in the COD for conducting a
referendum for the purpose of recognizing the Trade Unions in the establishment. The meeting shall be convened as expeditiously as possible and at any rate within a period of two
months of the date of receipt of a copy of this judgment.

2) The third respondent is further directed of forward the proceedings of such meeting if
there is a consensus, for the purpose of being considered by the Ministry of Labour to effect
necessary changes in the COD, with the consent of the management.
Prior to this a significant development has taken place as the recognised union which had

earlier opposed for change in rule also demanded that the BSNL should frame its own rules
of recognition. Thus the unions representing more than 90% employees are in favour of
BSNL's rules for proper and adequate redressal of staff grievances and the management
should neither ignore nor bulldoze this in the interest of industrial peace and harmony. Multiple
unions with full facilities are functioning for thousands of executives without even single verification even after evolving of rules for recognition. Is this not blatant discrimination against
non-executives.

Majority should bear in mind not to crush the minority but the minority (unions representing 0.06% employees) should not veto the aspirations of almost entire non-executive
employees for new rules. Workers want that their grievances and sufferings be alleviated
through participation of maximum number of workers in the Negotiating Machineries and all
should realise this.
News in Brief:

14-07-2012 : High handedness against SNEA and its leaders: As earlier reported BSNL HQR has transferred its central leaders including President and GS for Trade union activities. The leaders are facing Rule 14 Chargesheet also. Not only this the BSNL HQR has issued orders that SNEA leaders should not be given any meeting by officers. This is high handedness. The NFTE is firmly with SNEA against the victimisation. Trade unions in BSNL have to unite and resist such action.

2. Trais’s limit of 200 SMS on a SIM cancelled: Delhi High Court in its Judgement on 13th July has cancelled the limit of 200 SMS daily on a Sim fixed by Trai. Thus cap of 200 SMS per day on a sim is removed for personal use. Fixing of limit of SMS is violative of right of expression of views, the court held .

3. GSM industry body COAI today said regulator TRAI's analysis that mobile tariff will rise by 15 paise if spectrum is auctioned at its recommended price is "flawed" and "inconsistent with the market realities".
An industry body representing mobile phone companies offering services on the CDMA platform asked the telecoms department to take back excess airwaves held by GSM service providers and put them up for auction in addition to 13.75 MHz that will be put up for bidding. Adding that DoT should send notices demanding Rs 36,993 crore from incumbent GSM telcos that have unduly benefited from holding airwaves beyond the contracted limit of 6.2 MHz

Circle Union Comments:

Corporate office has issued a new instruction for GPF Cash authorization-Submission of applications by 20th.. Approval by 25th- Cash authorization by first week subject to the availability of fund.. We are not questioning about some regulation but  why conditioning with availability of fund.. Where the employees fund is going barring DOT? It is a hot issue at local level and we request our CHQ to take up this issue and set things right.
